Terms of Service

By creating an account, accessing, or using any part of the SecureIO SMS service (the "Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional guidelines or rules posted on the platform. These Terms constitute a legally binding agreement between you and SecureIO SMS.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

SecureIO SMS provides a platform that enables users to obtain temporary virtual phone numbers for the purpose of receiving SMS verification codes from third-party services. The Service is provided on a credit-based system where users purchase credits to obtain numbers and receive SMS messages.

We act as an intermediary between upstream SMS providers and end users. We do not guarantee the availability of any specific phone number, country, or service at any given time.

You must be at least 18 years of age to use this Service. By using the Service you represent and warrant that you are at least 18 years old and that you have the legal capacity to enter into these Terms.

The Service is not available to users in jurisdictions where the use of virtual phone numbers or third-party SMS verification services is prohibited by law.

To use the Service you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

You are responsible for maintaining the confidentiality of your API key and account credentials. You are solely responsible for all activity that occurs under your account. Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that contain inaccurate information or that violate these Terms.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may use the Service to:

• Receive one-time passwords (OTPs) for legitimate account registrations
• Test SMS functionality in software you are developing
• Verify accounts on platforms where you are the rightful account owner
• Any other lawful purpose consistent with the nature of the Service

You expressly agree not to use the Service to:

• Engage in fraud, identity theft, or impersonation of any person or entity
• Create accounts on third-party services in violation of their terms of service
• Send unsolicited communications (spam) of any kind
• Circumvent security measures, authentication systems, or access controls
• Harass, threaten, or harm any individual or organization
• Violate any applicable local, national, or international law or regulation
• Resell or redistribute the Service without prior written authorization
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service
• Use automated tools to abuse rate limits or overload our infrastructure

Violation of these prohibitions may result in immediate account termination without refund and may be reported to relevant law enforcement authorities.

The Service operates on a prepaid credit system. Credits have no cash value outside the platform and are non-transferable between accounts. Credit balances do not expire as long as your account remains active.

Prices for individual services are displayed on the platform at the time of purchase. We reserve the right to change pricing at any time. Price changes will not affect credits already purchased.

All payments are processed securely through our third-party payment providers (Stripe and Plisio). We do not store your full payment card details.

Credits are automatically refunded to your account when a number order is cancelled before an SMS is received, or when an upstream provider cancels an order.

Unused credit balances are generally non-refundable to the original payment method. Exceptions may be made at our sole discretion in cases of technical failure attributable to SecureIO SMS. To request a manual review, contact our support team.

We are not responsible for credits lost due to user error, including but not limited to purchasing numbers for incompatible services or failing to check for SMS within the allotted time window.

The Service and its original content, features, and functionality are and will remain the exclusive property of SecureIO SMS and its licensors. Our trademarks, logos, and trade dress may not be used in connection with any product or service without our prior written consent.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

We do not guarantee that any specific number, country, or service will be available at any given time. Availability depends on upstream providers beyond our direct control.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SECUREIO SMS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to defend, indemnify, and hold harmless SecureIO SMS and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit through the Service.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service you consent to the collection and use of information as described in our Privacy Policy.

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting our support team. Termination does not entitle you to a refund of any unused credits unless otherwise required by applicable law.

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts.

We reserve the right to modify these Terms at any time. We will notify users of material changes via a notification on the platform or by email. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

We encourage you to review these Terms periodically. The "Last updated" date at the top of this page indicates when the Terms were last revised.
